For services provided by SAMD Solutions GmbH, Am Glüsig 1C, 39365 Harbke, Germany, e-mail: info@samd-solutions.de (the “Contractor”) to its customers (the “Client”).
What the terms cover
The overview below states what each section of our terms regulates, so that you can see what you are agreeing to. It is a reading aid, not the contract text: the contract is concluded on the basis of the German version linked above.
General
Scope of the terms, and the rule that they apply to business customers only – we do not conclude contracts with consumers. Where other contract documents have been agreed, those documents take precedence in the event of a conflict.
Subject matter and scope of services
What is owed: pre-compliance EMC measurements, consulting and root cause analysis, including the use of our test centres. Our measurements are not accredited tests, and we do not owe a particular test result.
Your obligations to cooperate
What we need from you so that the service can be provided: the device under test in working condition, the necessary peripherals, information about operating states and known anomalies, and access at the agreed time.
Remuneration
How remuneration is calculated and when it becomes due, including the rules for remuneration measured by periods of time.
Liability and indemnification
The limits of liability and the cases in which they do not apply, together with the indemnification rules.
Term and termination
How long a contract runs and how it can be terminated.
Confidentiality and data protection
How we treat your technical information and measurement data, and the reference to the privacy policy.
Final provisions
Applicable law, place of jurisdiction, written form and severability.
Information on consumer arbitration
We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
